General terms and conditions for public events of MBO-Productions GmbH, applicable to all BEYOND events.
This English version is provided for convenience. In case of any discrepancy, the German version shall prevail.
1.1. These General Terms and Conditions (GTC) apply to all contracts and services concluded by MBO-Productions GmbH (hereinafter “MBO” or “Organizer”), in particular to events organized by MBO (including BEYOND) and the sale of tickets for these events, regardless of the ticketing provider through which the tickets were purchased (such as Eventfrog, Starticket, Ticketportal, Ticketcorner etc.). The GTC of the respective ticketing provider apply in addition.
1.2. The customer’s terms and conditions only apply if they have been expressly agreed in writing in advance.
1.3. These GTC also apply to visitors attending an event without a purchased ticket (e.g. via guest list, complimentary tickets, accreditation or free admission). By purchasing a ticket or at the latest by entering the event premises, the visitor accepts these GTC.
2.1. By purchasing a ticket for an MBO event, the customer concludes a contract with MBO for the services specified on the ticket. A contract is also concluded by acceptance of a written offer from MBO. MBO offers are valid for 14 days unless otherwise agreed, after which they expire. There is no offer period for ticket purchases.
2.2. MBO is fully liable for direct, proven damages caused by intentional or grossly negligent breach of duty by MBO. Liability for slight negligence, indirect damages, consequential damages (such as loss of profit) and for content on third-party websites is excluded. Exceptions are damages to life, body and health as well as mandatory statutory provisions (product liability).
2.3. The customer is fully liable for damages caused by gross negligence or unlawful intent. The ticket buyer’s liability for slight negligence is excluded.
2.4. MBO points out that, despite the implementation of a protection and hygiene concept, the risk of infection with the coronavirus (SARS-CoV-2) or other pathogens cannot be completely ruled out.
3.1. The ticket purchase between the customer and MBO is concluded when MBO or the ticketing provider activates the ticket. By purchasing a ticket, the customer accepts the safety, admission and age regulations and agrees that violations may lead to exclusion from the event without compensation.
3.2. Print@home, mobile or e-tickets are checked electronically at the entrance. The first holder of the ticket is admitted, after which the ticket is blocked. If the barcode/QR code is illegible, there is no entitlement to admission or compensation.
3.3. Personalized tickets are restricted to the person named on the ticket. The customer is responsible for the accuracy of the personal details.
3.4. There is no entitlement to replacement for lost or damaged tickets.
3.5. Objects that could endanger other visitors may not be brought along.
3.6. Event visitors must comply with the safety and event regulations of MBO or its agents.
3.7. MBO may refuse admission to or exclude visitors who do not meet the admission requirements or who violate the regulations.
3.8. Tickets can neither be exchanged nor returned, not even in the event of changes of date or venue. In the event of a definitive cancellation, the ticket must be returned to the point of sale within 30 days. Refunds are limited to the face value of the ticket excluding fees and may be reduced by up to 10%. In cases of force majeure (e.g. natural disasters, pandemics) there is no refund.
3.9. The event visitor acknowledges that ticketing providers accept payments on behalf of MBO.
3.10. MBO accepts no liability for technical malfunctions of the ticket sales system.
3.11. The commercial resale of tickets is prohibited. Violations result in the loss of ticket rights and may give rise to claims for damages.
3.12. The customer consents to the use of their data for marketing purposes by MBO. MBO’s privacy policy is an integral part of these GTC.
4.1. During events, at the entrance, throughout the event premises and in their immediate surroundings, MBO and third parties commissioned or authorized by MBO (e.g. photographers, videographers, content creators, media, partners and sponsors) make photo, video and audio recordings and carry out livestreams and live broadcasts. Visitors may be recognizably depicted, individually or as part of the audience.
4.2. By purchasing a ticket or entering the event premises, the visitor expressly consents to such recordings being made of them. The visitor grants MBO, free of charge, irrevocably and without limitation as to time, territory and content, the non-exclusive, transferable and sublicensable right to use, reproduce, distribute, make publicly available, broadcast and archive these recordings, as well as the visitor’s image, voice and name insofar as they appear therein, in whole or in part, unedited or edited (e.g. cut, retouched, combined with music, text or other content), in all known and future media and forms of use.
4.3. Use is permitted in particular for advertising, marketing, PR and communication purposes of MBO and its formats (including BEYOND), including the promotion of future events. This includes websites, social media (e.g. Instagram, TikTok, Facebook, YouTube), aftermovies, commercials and paid online advertising, newsletters, WhatsApp communities, posters, flyers and other print products, presentations, sponsorship and partner materials, press work and media reports.
4.4. MBO is entitled to pass on the recordings or the rights of use to partners, sponsors, artists, venues, media and commissioned service providers, insofar as this is related to the event, its coverage or the promotion of MBO and its formats.
4.5. The visitor has no claim to remuneration, attribution, prior approval or delivery of the recordings. There is no claim to the removal of recordings in which the visitor appears as part of the audience, incidentally or not in the foreground.
4.6. Visitors who do not wish to be specifically recorded can inform the recording team on site; targeted individual or portrait shots will then be avoided where possible. If a person objects to a recording published by MBO in which they are clearly recognizable in the foreground and asserts an overriding legitimate interest, MBO will remove this recording from the online channels operated by MBO itself within a reasonable period after written notice to matt@mbo-productions.ch, insofar as reasonable. Content that has already been printed, broadcast, passed on to or shared by third parties, as well as finished videos and campaigns, is excluded.
4.7. For minor visitors, consent is given by their legal guardians and is deemed granted by permitting the minor to attend the event.
4.8. Professional photo, video and audio recordings by visitors (e.g. with interchangeable-lens cameras, tripods, drones or external microphones) as well as livestreams are prohibited without MBO’s prior written consent. Recordings with mobile phones are permitted for private purposes. Commercial use of recordings made by visitors at the event is not permitted without MBO’s prior written consent.
4.9. The processing of recordings as personal data is carried out in accordance with MBO’s privacy policy.
5.1. MBO undertakes to provide the services ordered.
5.2. The customer is obliged to pay the agreed prices. This also applies to third-party services initiated by the customer.
5.3. Prices include statutory VAT.
5.4. Invoices are payable without deduction within 10 days. In the event of late payment, MBO is entitled to charge default interest in accordance with Art. 104 of the Swiss Code of Obligations.
5.5. MBO may request advance payments.
5.6. In justified cases, MBO may request a security deposit or advance payment up to the full remuneration.
5.7. Offsetting of claims by the customer is excluded.
6.1. Free cancellation is only possible with MBO’s written consent. There is no right of withdrawal for tickets.
6.2. If a deadline for free cancellation has been agreed, cancellation must be made in writing before the deadline expires.
7.1. MBO may withdraw from the contract if force majeure or other unforeseeable events make performance impossible.
7.2. If an advance payment is not made, MBO is entitled to terminate the contract.
7.3. MBO may terminate the contract without compensation in the event of false information or breaches of contract by the customer.
Bringing food and beverages is prohibited.
9.1. When procuring technical facilities, MBO acts on behalf of the customer.
9.2. The use of one’s own electrical equipment requires written consent.
9.3. Malfunctions caused by the customer’s own equipment are at the customer’s expense.
MBO is not liable for loss of or damage to items brought along, unless the damage was caused by gross negligence or intent.
The customer is liable for all damages caused by them, their guests or employees.
The use of personal data is governed by MBO’s privacy policy.
13.1. MBO may amend these GTC at any time and publish them on the website. The version published at the time of the ticket purchase or event attendance applies.
13.2. Place of performance and payment is MBO’s registered office in Zug.
13.3. These GTC and all contracts are governed by Swiss law. The exclusive place of jurisdiction is Zug, unless mandatory statutory provisions (in particular regarding consumer jurisdiction) provide otherwise.
13.4. Should any provision of these GTC be invalid, the remaining provisions shall remain in force. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the original provision.
